In these terms and conditions:
“Artist” means the creator of the Artwork.
“Artwork” means a piece of art created by an Artist, submitted in the Cliftons Art Prize.
“Cliftons” means Cliftons Operations Pty Limited A.C.N. 109 332 925.
“Cliftons Art Prize” means art prize run by Cliftons governed by these terms and conditions.
“Cliftons Art Prize Website” means www.cliftonsartprize.com.
“Entry” means a fully completed entry form and a photograph of the artwork, submitted by the Artist on Cliftons Art Prize Website.
“Region” refers to Auckland, Wellington, Hong Kong and Singapore.
“State” refers to Sydney, Melbourne, Brisbane, Canberra, Adelaide and Perth.

An Entry must be submitted on the Cliftons Art Prize website by 16 April 2012. 5pm Australian Eastern Standard Time, 5pm Western Standard Time, 5pm New Zealand Standard Time, 5pm Hong Kong Standard Time and 5pm Singapore Standard Time.
Any photograph of the Artwork must be in JPEG or GIF format and less than 1MB.
Each Artist is permitted to enter one entry.

Each artwork must have total dimensions greater than 90cm (ie. 10cm x 80cm, 45cm x 45cm).
Each Artwork must be available for sale.
Finalists of the Cliftons Art Prize will be notified in the week commencing 30 April 2012, via phone or email.
Finalists of the Cliftons Art Prize must deliver their originalaArtwork to their nominated Cliftons location of which may be found on the Cliftons Art Prize website.
The Artist’s name, address, contact details, the title of the Artwork and the medium must be clearly marked on the reverse of the artwork.
Cliftons will display the finalist’s Artworks at Cliftons Training Venues. The Winners’ Artworks will form part of the permanent Cliftons Art Collection. Artists must collect non-winning artworks at their own expense.
Award winners will be announced during the award evenings.
Winning artworks will be acquired by Cliftons. Prize money is payment for the winning artwork.

4. PRIZES

Each Regional winner or State winner will be awarded $2,000 USD
(Conversion rates $2,000 AUD; $15,000 HKD; $2,250 SGD; $2,250 NZD).
The Cliftons Art Prize winner will be awarded a total amount of $10,000 USD
(Conversion rates $10,000 AUD; $75,000 HKD; $12,500 SGD; $12,500 NZD).
Each winner is responsible for any and all applicable taxes on prize money.

5. LOSS OR DAMAGE

Cliftons will not be responsible for any loss or damage suffered whatsoever to any artwork while in transit or under the control of Cliftons.
Each Artist will indemnify Cliftons against all losses, liabilities, claims and expenses arising out of or in any way connected to any loss or damage suffered to the artwork created by that Artist.
Each Artist is responsible for his/her own insurance cover.

6. COSTS

Freight costs and all other charges relating to the delivery and collection of each Artwork entered into the Cliftons Art Prize is the sole responsibility of the Artist that created that artwork.

7. INTELLECTUAL PROPERTY RIGHTS

Each Artist warrants that the Artist does not breach any international copyright laws.
Any infringement of copyright laws by an Artist will be the sole responsibility of that Artist.
Each Artist will indemnify Cliftons against all losses, liabilities, claims and expenses arising out of or in any way connected to any breach of intellectual property rights in relation to the Artwork created by that Artist.
Each Artist selected as a finalist authorises Cliftons to publish their Artwork free of copyright, totally or partly, in all publications (catalogues, folders, posters, slide shows, media releases, brochures, etc) related to this art prize, as well as on the Cliftons Websites.

8. DISQUALIFICATION

Cliftons reserves the right in its sole discretion to disqualify any individual whom Cliftons has reason to
believe has breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct which may  jeopardise the fair and proper conduct of the Cliftons Art Prize. Cliftons reserves the right to seek damages and relief from all persons responsible for such acts. Cliftons decision to disqualify any individual is final and there is no right of appeal.
A disqualified Artist will not be eligible for any prize money.

9. PROMOTIONAL USE OF ARTWORK

Each Artist agrees to allow Cliftons the unconditional use of the artwork owned by that Artist for promotions,
media, advertising and announcements without compensation, consideration, notice, review or consent where permitted.
Each Artist may be asked to provide high-resolution file of the photograph of their artwork for promotional material.

10. JUDGES AND DECISION

Cliftons shall appoint judges who shall decide each
winner. No Artist has any say about who is appointed as a judge. The decision of the judges appointed by Cliftons is final. There is no right of appeal. The judges are not obliged to give any reason for their decision.
All decisions regarding the interpretation of matters including rules and eligibility will be made by Cliftons
in Cliftons’ sole discretion.
Cliftons will not enter into correspondence regarding the award winners.

11. GENERAL

11.1

Employees of Cliftons and their immediate family members and associated agencies and companies of Cliftons are not eligible to enter the Cliftons Art Prize.
